Terms and Conditions for Drivers

These Terms and Conditions apply between Vertt AG ("Vertt") and the provider of ride services ("Driver") regarding the use of the Vertt App for the purpose of arranging ride services. By using the Vertt App for the first time and with each subsequent use, the Driver agrees to be legally bound by these Terms and Conditions. Any terms and conditions provided by the Driver shall only become part of the agreement if Vertt has explicitly agreed to them in writing.
Registration
1. Before using the Vertt App, the Driver must register with complete and truthful personal information and upload the required documents. These must be kept up to date.
2. The Driver is identified via the phone number provided. If this changes, the Driver must inform Vertt immediately so re-identification can take place.
3. Upon successful registration, the Driver will receive a confirmation email and the Vertt App account will be activated. Only then (and only while all requirements under these Terms are fulfilled) is the Driver authorized to use the Vertt App and Vertt’s services.
Services Provided by Vertt
4. Vertt acts solely as an operator of a technology platform that facilitates the arrangement of ride services. Vertt connects Drivers with potential passengers who book ride services via the Vertt App. Such a booking constitutes an offer to enter into a transport contract. The Driver can see the relevant passenger information (e.g. name, pick-up location) and may accept or decline the request. Upon acceptance, a transport contract between the Driver and the passenger is formed. Communication takes place via the Vertt App, anonymized SMS, or anonymized calls.
5. The ride destination is only disclosed once the passenger enters the vehicle. The Vertt App displays the fare after the trip ends.
6. The Vertt App can be downloaded from the App Store or Google Play Store for use on internet-enabled mobile devices such as smartphones and tablets.
7. Vertt grants the Driver a non-exclusive, non-sublicensable, non-transferable license to use the Vertt App and website under these Terms. This license may be revoked by Vertt at any time without compensation.
8. All ownership, copyright, and other intellectual property rights in the Vertt App and software remain with Vertt. Drivers may not copy, modify, reverse engineer, decompile, or distribute the software.
9. There is no entitlement to continuous or uninterrupted availability of the Vertt App. Vertt strives to ensure the highest possible availability and to rectify disruptions quickly but may suspend services temporarily without prior individual notice.
10. Drivers must log in using the username and password chosen during registration. These credentials must be kept secure and not disclosed to third parties. Unauthorized access must be reported to Vertt immediately.
11. Vertt may from time to time implement improvements and updates to the Vertt App, which may include patches, bug fixes, upgrades, or modifications ("Updates"). Updates may change or remove specific features. Drivers acknowledge that (i) Vertt is not obligated to provide Updates or maintain specific functionalities and (ii) all Updates form part of the Vertt App and are subject to these Terms.
12. Drivers are solely responsible for internet access and the configuration, compatibility, and performance of their device, as well as keeping the Vertt App updated.
Payment and Billing
13. The estimated fare (including VAT) is determined by Vertt before the ride begins and shown to the Driver only after completion. It includes a base fare, per-minute and per-kilometer components, surcharges based on demand and geography, and a minimum fare depending on vehicle category. The current pricing sheet is available at www.vertt.ch/ride-with-vertt.
14. Passengers pay using the credit or debit card registered in the Vertt App. Vertt guarantees payment and assumes the collection risk.
15. Drivers may enable cash payment. In this case, the Driver assumes full responsibility for collecting the fare and holding sufficient change. The Driver remains liable for Vertt’s commission.
16. Passengers may tip Drivers via the app or in cash. No commission is charged on tips.
17. Vertt’s commission is 15% of the fare plus 7.7% VAT.
18. Vertt may adjust the commission rate at any time.
19. Drivers can view current earnings and commission details in the Vertt App. Weekly payouts are made to the registered bank account, minus the commission (plus VAT). For cash rides, the fee is deducted weekly from the Driver’s balance. If this is not possible, payment must be made manually. Vertt may suspend access for overdue payments exceeding seven days.
20. Passengers may cancel a ride within five minutes of booking acceptance without charge. Late cancellations or no-shows incur a cancellation fee, which is credited to the Driver (less commission). Current rates at www.vertt.ch/ride-with-vertt.
21. Drivers are not employees and are not guaranteed minimum hours or earnings. They are solely responsible for taxes and social security contributions and must fully indemnify Vertt in this regard.
22. Vertt may issue promotional codes or similar discounts at its discretion. Vertt covers the full amount of any resulting revenue reductions. Drivers always receive the full fare.
Driver Requirements and Obligations
23. Vertt expects Drivers to be reliable, professional, and well-groomed, providing passengers with a safe and pleasant experience.
24. Drivers must hold a valid Swiss driver’s license with a BPT Code 121 for professional transport. Local route knowledge certificates are advantageous.
25. Drivers must comply with applicable regulations, including transport, fare, and traffic laws, as well as working and rest time regulations. Penalties are the Driver’s responsibility.
26. For airport rides, Drivers must hold the required airport parking permits. Any airport-related costs are borne by the Driver.
27. Upon accepting a booking, the Driver commits to providing the service as booked, arriving on time and following the app’s navigation route.
28. If the Driver cannot fulfill a booking, it must be canceled promptly in the app.
29. After accepting a booking, the Driver agrees to share their full name, photo, and vehicle license plate with the passenger.
Vehicle
30. The vehicle must have the necessary installations for commercial passenger transport, including a trip recorder. 31. The vehicle must have full insurance coverage and be authorized for commercial use. 32. Drivers must assign their vehicle to one or more categories (e.g. Vertt, Premium, Lux, Green). Category criteria are listed at www.vertt.ch/vertt-driver. 33. Maintenance and repairs must be completed without delay. 34. Vehicles must be roadworthy, clean, non-smoking, and equipped with a child seat for children aged 3 and above. 35. All vehicle-related costs (fuel, insurance, repairs, cleaning, taxes) are the Driver’s responsibility.
Ratings
36. To ensure service quality and safety, passengers and Drivers may rate each other. Ratings are anonymous.
37. All ratings and reviews must be honest and fair. Vertt may remove inappropriate or Ratingsmalicious content.
38. There is no entitlement to modification or deletion of ratings or reviews.
Feedback
39. Vertt may use Driver feedback, reviews, and comments, including the Driver’s name, for publication and marketing purposes.
Third-Party Services
40. Vertt may show or offer third-party content (e.g. data, apps, services) or links to third-party websites. Use is at the Driver’s own risk. Vertt disclaims all liability for such content or services.
Privacy Policy
41. Vertt collects, stores, and processes Driver data in accordance with its privacy policy, available at www.vertt.ch/privacy-policy. By accepting these Terms, the Driver consents to the privacy policy.
Liability
42. Vertt is not liable for the proper functionality of the Vertt App or damages arising from its use. Vertt offers no warranties regarding uninterrupted access or absence of harmful components.
43. The Driver is responsible for all claims or costs arising from accidents or third-party damages and fully indemnifies Vertt.
44. If passengers or third parties claim damages due to cancellations or incomplete rides, the Driver must fully indemnify Vertt.
45. Drivers shall indemnify Vertt for all damages resulting from violations of these Terms or other legal violations.
46. The Driver must notify Vertt immediately if third parties assert claims against the Driver or Vertt.
47. The Driver acknowledges and accepts all risks associated with using the Vertt App, to the fullest extent permitted by law. Vertt disclaims all liability accordingly.
Duration and Termination
48. The agreement ends automatically if the Driver no longer meets the requirements outlined in these Terms.
49. Vertt may terminate the agreement or block the Driver’s access to the app at any time without explanation.
50. The Driver may terminate the agreement at any time via the app.
51. Inappropriate Driver conduct may result in warnings or permanent exclusion from the Vertt App.
Severability Clause
52. If any part of these Terms is found to be invalid or unenforceable, the remaining provisions remain unaffected. An effective provision closest in meaning shall replace the invalid one. The same applies to any contractual gaps.
Changes to the Terms
53. Vertt may change these Terms at any time and apply the updated version to existing agreements.
Place of Jurisdiction and Governing Law
54. Place of performance and exclusive jurisdiction is Vertt’s registered office. These Terms are governed by Swiss law to the exclusion of international private law.
